			<content:encoded><![CDATA[<p><span id="more-2483"></span>Foreignersinuk &#8211; It is not a new visa category, as other international media have said, but it nonetheless might come to you as a surprise: the British government will allow you to enter the UK and even settle there if you prove you are financially dependent on the income of your relative settled there. Even the more so if they have become British citizens in the meantime.</p>
<p>Let’s run through the UKBA rules.</p>

			<content:encoded><![CDATA[<p><span id="more-2429"></span>UKBA &#8211; The UK Border Agency has announced that refugees and migrants with humanitarian protection in the UK will be allowed to apply for settlement and British citizenship under the current rules if their initial five-year permission to stay here will end between August 2010 and the date when the new system of &#8216;earned citizenship&#8217; comes into force (scheduled for July 2011).</p>
<p>If you were granted refugee status or humanitarian protection <strong>between August 2005 and July 2006</strong>, and your initial five-year permission to stay will expire before earned citizenship comes into force, you will still be able to apply for settlement (also known as &#8216;indefinite leave to remain&#8217;). You will be expected to apply no more than 28 days before your initial permission to stay expires.</p>

<p>The Guardian &#8211; ukccen was born abroad to an unmarried British father, and so cannot apply for a  British passport. Is this discriminatory?</p>
<p>ukccen asks:</p>

As of 13  January 2010, all children born to a British parent will have the right to apply  for a British passport, except those who fall under my category. Adult children  of unmarried British fathers born before 1 July 2006 are the only group of  children being discriminated against in terms of a path to British citizenship  &#8230; Why does this unfairness continue to be allowed?</p></blockquote>
<p>Both <a title="ukccen's query" href="http://www.guardian.co.uk/commentisfree/libertycentral/2010/jan/11/liberty-clinic-open-thread?showallcomments=true#CommentKey:c65723b9-2a0b-4e40-9462-30d0263f5bdc">ukccen</a> and <a title="EqualityMatters comment" href="http://www.guardian.co.uk/commentisfree/libertycentral/2010/jan/11/liberty-clinic-open-thread?showallcomments=true#CommentKey:c5bf32ea-a21d-4ba9-ab39-7f1cd84c4a1d">EqualityMatters</a> have raised similar issues in the same week. The issues are, however, different  and, as replying to both would be very lengthy we are going to reply to ukccen&#8217;s  this week and will try to come back to EqualityMatter in a future week. It is  not clear from the enquiry whether ukccen is male or female but I shall assume  for purposes of the advice that she is female. In any case, the advice offered  is not affected by her sex.</p>
